Terms of Service
Effective 27 August 2026 · Ads By Creators is operated by Voicedraw Labs.
1. Who We Are
"Ads By Creators" ("ABC") is a managed influencer-marketing service operated by Voicedraw Labs, a sole proprietorship of Ajay Panthagani, based in Hyderabad, Telangana, India ("Voicedraw Labs", "we", "us", "our").
These Terms of Service ("Terms") govern your use of adsbycreators.com (our marketing site) and app.adsbycreators.com (the creator platform) (together, the "Platform"), and of ABC generally. In these Terms, "Creator" means a person who registers on the creator platform; "Brand" means a business (or its representative) that engages ABC for influencer-marketing campaigns; "you" means any person using the Platform, whether a visitor, Creator, or Brand representative.
Two related documents form part of our legal framework: the Creator Terms (at adsbycreators.com/creator-terms), which govern Creators' participation in campaigns, and the Privacy Policy (at adsbycreators.com/privacy), which explains how we handle personal data. The Privacy Policy is a notice about how we handle personal data; it is referenced by these Terms but is not a contractual term of them.
2. Acceptance of these Terms
By accessing or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
If you sign in to the creator platform, you additionally accept the Creator Terms, which are incorporated into these Terms by reference for Creators. If you use the Platform on behalf of a business (for example, as a Brand representative), you confirm that you are authorised to bind that business, and "you" includes that business.
These Terms are an electronic record under the Information Technology Act, 2000 and the rules made under it, and do not require a physical or digital signature.
3. Eligibility
You may use the Platform only if you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872. The Platform is not directed at, and must not be used by, anyone under 18.
If we learn that an account is held by a person under 18 or by someone not competent to contract, we may suspend or close it.
4. The Services
ABC is a managed influencer-marketing service. What we offer today is as follows, and nothing on the Platform should be read as promising more:
- Creator platform: Creators self-onboard at app.adsbycreators.com by signing in with Instagram. With the Creator's consent, ABC imports approximately 12 months of the Creator's Reels, media insights (views, reach, likes, comments, shares, saves) and audience demographics (age, gender, top cities/countries), and re-syncs this data weekly. Creators also provide campaign preferences: content categories, city, languages, and topics they will not promote.
- Campaign matching: Brand campaigns are being onboarded. Campaign matching is operated by ABC with humans in the loop; it is not a self-serve marketplace.
- Brand engagement: Brands currently engage ABC by email at hello@adsbycreators.com. There is no self-serve brand product on the Platform at this time. Section 8 (Brand Engagement and Creator Cards) sets out the terms on which Brands receive creator information.
ABC never posts on a Creator's behalf, and never shares a Creator's contact details or individual rates with Brands.
We do not guarantee any campaign volume, earnings, matches, or timelines to any Creator or Brand. Registering on the Platform does not entitle a Creator to receive campaign opportunities.
5. Accounts and Instagram Sign-In
Accounts exist only on the creator platform (app.adsbycreators.com). Visitors to the marketing site do not need an account, and Brands are currently engaged by email rather than through accounts.
Creator accounts are created by signing in with Instagram, using Meta's "Instagram API with Instagram Login". The following rules apply:
- Professional accounts only: you must connect an Instagram professional (business or creator) account. Personal Instagram accounts are not supported.
- Permissions: we request only the instagram_business_basic and instagram_business_manage_insights scopes, used as described in the Privacy Policy.
- One account: you may connect only one Instagram account per Creator profile, and it must be an account you own and operate.
- Truthful information: all information you provide (including campaign preferences) must be accurate and kept up to date. Do not impersonate anyone or misrepresent your identity, audience, or affiliation.
- Security: you are responsible for maintaining the security of the devices and credentials used to access your account, and for activity that occurs under your account. Tell us promptly at hello@adsbycreators.com if you suspect unauthorised access.
You may disconnect ABC's access to your Instagram data at any time through Instagram's own settings; the Privacy Policy explains what happens to your data when you do.
6. Creator Terms Govern Campaign Participation
Participation in campaigns — including campaign opportunities, deliverables, compensation based on eligible views, measurement, payment, content licences, and conduct standards such as the ASCI Guidelines for Influencer Advertising in Digital Media — is governed by the Creator Terms at adsbycreators.com/creator-terms, together with the terms of each individual campaign.
For Creators, the Creator Terms are incorporated into these Terms by reference. If these documents conflict on a matter concerning a Creator's participation in the ABC network or in campaigns, the Creator Terms prevail; on all other matters concerning the Platform, these Terms prevail.
7. Acceptable Use
You must use the Platform lawfully and honestly. In particular, you must not:
- scrape, harvest, or bulk-extract data from the Platform, or access it by automated means — except that reputable search engines may index publicly available pages of the marketing site in the ordinary way;
- reverse engineer, decompile, or disassemble any part of the Platform, or attempt to derive its source code, except to the extent such a restriction cannot be applied under law;
- use the Platform for any unlawful purpose, or in a way that violates any applicable law, including the Information Technology Act, 2000 and the Consumer Protection Act, 2019;
- misrepresent your identity, audience, metrics, or affiliation, or provide false information to us or to any Brand;
- interfere with the operation or security of the Platform, probe or test its vulnerabilities without our written permission, or introduce malware or other harmful code;
- circumvent or attempt to circumvent any access controls, rate limits, or technical protections;
- use another person's account, or share your account access with others;
- copy, frame, or mirror the Platform or any part of it, other than as these Terms allow.
We may investigate suspected violations and take proportionate action under Section 15 (Suspension and Termination).
8. Brand Engagement and Creator Cards
When ABC proposes Creators for a campaign, the Brand receives only campaign-specific creator cards: the Creator's Instagram handle, public profile figures, and the performance metrics and audience-demographic summaries relevant to that campaign. Brands never receive a Creator's contact details, individual rates, or access to the full creator pool.
By engaging ABC (including by email) and receiving creator cards or any other Creator information from us, a Brand agrees to the following conditions, which are a requirement of our working with the Brand:
- Purpose limitation: use creator cards and Creator information solely to evaluate and run the specific campaign for which we provided them, and for no other purpose;
- Confidentiality: keep creator cards and Creator information confidential, and do not disclose them outside the Brand's campaign team and its professional advisers;
- No off-platform circumvention: for 12 months after receiving a creator card, do not use it to contact or engage that Creator directly or indirectly for influencer-marketing services other than through ABC;
- No databases: do not compile, retain, or build databases, profiles, or datasets from creator cards or Creator information, and delete them when the campaign evaluation or campaign ends.
Any separate written agreement between a Brand and Voicedraw Labs applies in addition to these conditions and, in case of conflict, prevails between the Brand and us.
9. Intellectual Property
The Platform — including its software, design, text, graphics, and the "Ads By Creators" and "ABC" names and marks — is owned by or licensed to Voicedraw Labs and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Platform for its intended purpose. No other rights are granted, and we reserve all rights not expressly granted.
Creators own their content. Nothing in these Terms transfers ownership of a Creator's content to us or to any Brand. Any licences over campaign content are granted only per campaign, as set out in the Creator Terms and the relevant campaign brief.
If you send us feedback or suggestions about the Platform, we may use them without restriction or payment, but this does not give us any rights over your content.
10. Third-Party Services: Instagram and Meta
The creator platform depends on Instagram and on Meta's APIs. Your use of Instagram remains governed by Meta's own terms and policies, which apply in addition to these Terms. You are responsible for complying with them.
ABC and Voicedraw Labs are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram. "Instagram" is a trademark of its owner and is used only to identify the service we integrate with.
We do not control Instagram or Meta's APIs. If Meta changes, restricts, or discontinues API access, some or all of the creator platform's features may change or become unavailable, and we are not liable for that to the extent it is outside our reasonable control.
11. Privacy
Our Privacy Policy at adsbycreators.com/privacy explains what personal data we collect (including Instagram data received through Meta's API), why we collect it, how long we keep it, who we share it with, and how you can exercise your rights — including access, correction, erasure, and grievance redressal under the Digital Personal Data Protection Act, 2023.
Please read it. The Privacy Policy is a notice, not a contractual term of these Terms; our processing of your personal data is based on the consent and notice framework described in the Privacy Policy itself.
12. Disclaimers
The Platform is provided "as is" and "as available", to the extent such a disclaimer is permitted under Indian law. We do not warrant that the Platform will be uninterrupted, error-free, or secure, that data (including Instagram metrics ingested through Meta's API) will be complete or accurate, or that the Platform will meet your requirements.
We do not guarantee any commercial outcome — including campaign opportunities, campaign volume, earnings, audience growth, or Brand engagement results.
Nothing in this section limits or excludes any right you have under law that cannot be limited or excluded, including any non-waivable right under the Consumer Protection Act, 2019.
13. Limitation of Liability
To the extent permitted by Indian law, we are not liable for indirect, incidental, special, or consequential loss, loss of profits, loss of business or goodwill, or loss of data arising out of or in connection with the Platform or these Terms.
To the extent permitted by Indian law, our total aggregate liability arising out of or in connection with the Platform or these Terms is capped at the greater of (a) the amounts paid or payable by us to you in the 12 months before the event giving rise to the claim, and (b) INR 10,000.
These limitations do not apply to liability arising from our fraud or wilful misconduct, or to any liability that cannot be limited or excluded under applicable law, including non-waivable rights under the Consumer Protection Act, 2019.
14. Indemnity
You agree to indemnify Voicedraw Labs against third-party claims, and the reasonable costs (including reasonable legal fees) of defending them, to the extent they arise from: (a) your breach of these Terms; (b) your unlawful use of the Platform; or (c) your infringement of a third party's rights through your use of the Platform.
This indemnity is scoped as follows: it does not apply to the extent a claim arises from our own breach of these Terms, our fraud, or our wilful misconduct. We will notify you promptly of any claim we seek indemnity for, allow you a reasonable opportunity to participate in the defence, and not settle a claim in a way that imposes obligations on you without your consent (not to be unreasonably withheld).
Where the Creator Terms provide indemnities in the context of campaigns (including any indemnity from us that they set out), those provisions govern campaign matters.
15. Suspension and Termination
You may stop using the Platform at any time. Creators may close their account by disconnecting ABC in Instagram's settings or by emailing hello@adsbycreators.com; the effect on in-flight campaigns is governed by the Creator Terms, and the effect on your data is described in the Privacy Policy.
We may suspend or terminate your access to the Platform, in whole or in part, where we have reasonable grounds — including breach of these Terms or the Creator Terms, credible fraud signals (such as deceptive engagement inflation), brand-safety concerns, unlawful activity, or a legal requirement. Except where immediate action is necessary (for example, to address fraud, security, or legal risk), we will give you notice stating the reason, and you may raise the matter through the grievance route in Section 18.
Suspension or termination does not by itself extinguish amounts properly payable for campaign deliverables already completed in accordance with the Creator Terms.
16. Changes to the Services and to these Terms
We are an evolving service and may change, add, or withdraw Platform features. If a change materially reduces functionality that Creators rely on for in-flight campaigns, we will give reasonable notice where practicable.
We may update these Terms from time to time. For material changes we will give notice — on the Platform or by email to registered Creators — before the changes take effect, along with the new effective date. Continuing to use the Platform after the effective date means you accept the updated Terms; if you do not accept them, stop using the Platform and, if you are a Creator, close your account.
The current version of these Terms is always available at adsbycreators.com/terms.
17. Governing Law, Dispute Resolution and Jurisdiction
These Terms are governed by the laws of India.
If a dispute arises out of or in connection with these Terms or the Platform, the parties will first attempt to resolve it through good-faith negotiation, initiated by written notice (for us: hello@adsbycreators.com) and pursued for at least 30 days.
If negotiation fails, the dispute will be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by agreement of the parties, failing which — if the parties do not agree within 30 days of a written request to arbitrate — appointed under section 11 of the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration is Hyderabad, Telangana, and the language of arbitration is English. The arbitrator's award is final and binding, subject to the Act.
Subject to the arbitration agreement above, the courts at Hyderabad, Telangana have exclusive jurisdiction over disputes arising out of or in connection with these Terms.
Nothing in this section excludes or limits any right you may have under consumer-protection law that cannot be waived, including any right to approach a consumer forum under the Consumer Protection Act, 2019, or your right to approach the Data Protection Board of India as described in the Privacy Policy.
18. Grievance Officer and Notices
In accordance with the Information Technology Act, 2000 and the rules made under it, and the Digital Personal Data Protection Act, 2023, our Grievance Officer can be reached at:

We will acknowledge grievances within 72 hours and resolve them within 15 days, or within any shorter period required by applicable law. If your grievance concerns personal data and you are not satisfied after exhausting this route, you may complain to the Data Protection Board of India through its prescribed complaint mechanism, as described in the Privacy Policy.
Legal notices to us must be sent by email to hello@adsbycreators.com. Notices to you may be given on the Platform (including within your account on the creator platform) or, where we hold a contact email address for you as described in the Privacy Policy, by email to that address, and are deemed received when posted or sent.
19. General Provisions
- Entire agreement: these Terms, together with the Creator Terms (for Creators) and any per-campaign terms, are the entire agreement between you and Voicedraw Labs about the Platform, and supersede prior discussions on that subject. The Privacy Policy explains how we handle personal data and is a notice referenced by these Terms, not a contractual term of them.
- Assignment: you may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a reorganisation, merger, or sale of the business, with notice to you.
- Severability: if any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions remain in full force.
- Waiver: a failure or delay in enforcing any provision is not a waiver of it. A waiver is effective only if in writing.
- Force majeure: neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including natural disasters, war, civil unrest, government action, internet or utility failures, or failures of third-party platforms and APIs (including Meta's) — except for payment obligations already accrued.
- Survival: provisions that by their nature should survive — including Sections 8 (Brand Engagement and Creator Cards), 9 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnity), 17 (Governing Law, Dispute Resolution and Jurisdiction), and this Section 19 — survive termination.
- No third-party rights: these Terms do not confer rights on anyone other than you and Voicedraw Labs, except as expressly stated.
- Relationship: nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and Voicedraw Labs.
- Language and interpretation: these Terms are drafted in English. Headings are for convenience and do not affect interpretation; "including" means "including without limitation".
